goodr F’ing Rewards Loyalty Program Terms and Conditions

PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY. BY ACCESSING OR PARTICIPATING IN THE F’ING REWARDS LOYALTY PROGRAM, YOU AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS AND ALL TERMS INCORPORATED BY REFERENCE. IF YOU DO NOT AGREE TO THESE TERMS AND CONDITIONS, YOU MAY NOT PARTICIPATE IN THE F’ING REWARD LOYALTY PROGRAM.

The goodr F’ing Rewards Loyalty Program (“F’ing Rewards”) is operated by goodr LLC (“goodr”). These Terms and Conditions (“Terms”) apply to your access to and participation in the F’ing Rewards program. These Terms are subject to, and do not alter in any way, goodr’s Terms and Conditions and Privacy Policy. Please review the Privacy Policy carefully to understand how goodr collects and uses personal information. In the event of any conflict between these Terms and the goodr.com Terms and Conditions, the Terms and Conditions will control.

By joining F’ing Rewards, you and goodr, its predecessors in interest, successors, and assigns, as well as each of their respective past, present, and future parents, subsidiaries and affiliates (collectively, “goodr Parties”) agree that all disputes between you and goodr Parties shall be resolved exclusively by individual arbitration instead of jury trials or class actions, as provided in the Terms and Conditions. PLEASE READ THE TERMS AND CONDITIONS CAREFULLY: MANDATORY ARBITRATION MEANS THAT YOU AND goodr PARTIES ARE EACH WAIVING THE RIGHT TO A JURY TRIAL OR TO PARTICIPATE IN ANY CLASS OR COLLECTIVE ACTION.

All F’ing Rewards benefits, points, awards, and status are subject to availability and may be changed by goodr at any time without notice. goodr may terminate F’ing Rewards, in whole or in part, at goodr’s sole discretion. goodr may also choose to substitute a similar loyalty program at any time. If F’ing Rewards is terminated, all unredeemed points will be forfeited without any obligation or liability.

These Terms supersede all previous terms and conditions applicable to F’ing Rewards. Except as otherwise expressly prohibited or limited by applicable laws, goodr may at any time amend, modify or supplement these Terms, the structure for earning awards, points, or tier status at any time, with or without notice, even though such changes may affect the value of accumulated points, or the ability to obtain certain benefits. You are responsible for remaining knowledgeable of the Terms and any changes. Your continued participation in F’ing Rewards will constitute your acceptance of any such changes to these Terms or the F’ing Rewards program. If you object to these Terms or any changes hereto or at any time become dissatisfied with F’ing Rewards, your sole recourse shall be to opt-out of F’ing Rewards. goodr shall not be liable to you in any way for any value or benefits you may lose as a result of any changes made to F’ing Rewards, including, without limitation, any points or rewards.

F’ing Rewards Eligibility. F’ing Rewards is a loyalty program offered to goodr.com account holders. You must be a United States resident (including Washington, D.C.) and at least 18 years of age to participate in the F’ing Rewards program. goodr determines United States residency based on your shipping address. If you change your shipping address to one that is not located in the United States (including Washington, D.C.), you will no longer be able to receive or redeem F’ing Rewards benefits, including previously earned F’ing Rewards benefits. 

Description of F’ing Rewards. F’ing Rewards is a free program to reward our customers for their loyalty. Members receive certain promotional offers and benefits and have the opportunity to achieve membership in rewards tiers and unlock additional promotional rewards.

Joining F’ing Rewards (U.S. Customers, Excluding California). To join F’ing Rewards, simply log into your existing goodr.com account, or if you do not already have an account, register for an account on goodr.com and opt in to F’ing Rewards. U.S. customers with existing goodr.com accounts as of January 1, 2023, will automatically earn points towards F’ing Rewards with every purchase. If you are a U.S. customer with an existing goodr.com account as of January 1, 2023, you must still agree to these Terms to participate in F’ing Rewards. There are no membership fees associated with the F’ing Rewards program. You may opt out of F’ing Rewards at any time by emailing us at support@goodr.zendesk.com. If you elect to opt-out or cancel your account, you (i) will not be able to redeem any unused F’ing Rewards Perks or points, (ii) will not be able to retrieve previously-earned points, Perks, or tier status if you elect to opt in at a later time, and (iii) will not be able to earn points for purchases or actions taken while not opted in to F’ing Rewards.

Joining F’ing Rewards (California Customers). To join F’ing Rewards, simply log into your existing goodr.com account, or if you do not already have an account, register for an account on goodr.com and opt-in to F’ing Rewards. There are no membership fees associated with the F’ing Rewards program. You may opt out of F’ing Rewards at any time by emailing us at support@goodr.zendesk.com. If you elect to opt-out or cancel your account, you (i) will not be able to redeem any unused F’ing Rewards Perks or points, (ii) will not be able to retrieve previously-earned points, Perks, or tier status if you elect to opt in at a later time, and (iii) will not be able to earn points for purchases or actions taken while not opted into F’ing Rewards.

Attaining Tier Status. F’ing Rewards members will earn points from Qualified Orders, as you earn points, you may qualify for placement in a reward tier, each with its own Perks.

Currently, there are four F’ing Rewards tiers: Tier 1 (1-149 F’ing Rewards points); Tier 2 (150-249 F’ing Rewards points); Tier 3 (250-499 F’ing Rewards points); and Tier 4 (500+ F’ing Rewards points). Detailed descriptions of the benefits provided by membership in each tier, as well as opportunities for obtaining points, can be und in our FAQs.

Rewards members receive 1 point for every $1 spent on eligible purchases on goodr.com (“Qualified Orders”), and may potentially earn more points based on promotional offerings and on tier-specific points multipliers. Eligible purchases include regular and sale priced merchandise and exclude gift cards, sales tax, state fees, discounts, shipping and delivery charges and/or other excluded charges specified by us from time to time. Points are only awarded based on full dollars spent; purchase prices will be rounded down to the nearest full dollar amount in order to calculate rewards.

To make a Qualified Order you must be signed into your goodr.com account when placing the order. You can check your orders in the “My Account” Dashboard to see which orders are Qualified Orders and monitor your point total and tier status. If you make a Qualified Order and later return some or all the items in the order, that order is no longer a Qualified Order, and any points earned for items later returned will be removed from your account.

Points based on purchases will be allocated to your account thirty (30) days after the day that your Qualified Order ships and will be shown as “pending” until such date. 

If you collect enough points to qualify you for a new tier, whether from a single order or when points are added to previous points earned within the earning period (as described below), your new tier status will take effect immediately when the minimum number of points for the applicable tier is allocated to your account. Points earned for purchases that are later returned will be subtracted from your F’ing Rewards account. If the points attributable to a returned purchase were responsible for increasing your tier status, goodr reserves the right to reduce your tier status accordingly.

Rewards, benefits and/or points earned through F’ing Rewards have no cash value, are non-transferable, and you have no property rights in or to rewards or other F’ing Rewards benefits. Rewards cannot be exchanged or returned for points, another product or a monetary refund.

Maintaining Tier Status. Once you achieve a new tier status, you will remain in that tier indefinitely. Goodr expressly reserves the right to modify these membership status criteria.

F’ing Rewards Perks. F’ing Rewards members may receive personalized offers, early access, and discounts(“Perks”) based on their tier status. Some notifications or offers may be sent by email, and you will need to opt-in to emails from goodr to receive these notifications or offers; account information such tier status, point totals, and available offers will also typically be accessible by logging into your account on goodr.com. Perks may be customized based on purchase behaviors and preferences. Perks may have certain restrictions, including expiration dates and short, time-limited redemption periods. Read each offer carefully for specific details. F’ing Rewards and Perks must be redeemed at the time of purchase and may not be applied retroactively. Only the account holder may use and access the F’ing Rewards Perks.

goodr reserves the right to change the Perks provided to F’ing Rewards Members and tier status members, and to change the specific Perks offered at various tier statuses. At present, the Perks potentially available, based on tier status, include:

  • Bonus points for signup;
  • Point Multiplier based on tier

Goodr reserves the right to offer the following Perks in the future:

  • Early access to promotions and new arrivals;
  • Discounts on purchases on goodr.com;
  • Exclusive loyalty promotions.

No redemption opportunities are guaranteed, and any redemption opportunity may be subject to its own terms and restrictions, including expiration dates. ANY EARNED POINTS EXPIRE SIX MONTHS FROM THE DATE THEY ARE EARNED.

goodr expressly reserves the right to offer similar (or identical) Perks or other benefits, including participation in promotional offers or sweepstakes, to both F’ing Rewards members and non-members.

All Perks are promotional only and have no cash value.

Your F’ing Rewards Account Is Personal. Each goodr customer may create only one F’ing Rewards account. The F’ing Rewards account is personal and may not be assigned, transferred, or shared with family, friends, or for commercial purposes. F’ing Rewards account and associated benefits are NOT intended for those purchasing items for resale.

Miscellaneous. goodr reserves the right to terminate, discontinue, cancel, or change the F’ing Rewards program at any time, in goodr’s sole discretion, and without notice to you. Any changes to these Terms will be updated on the goodr.com website. goodr also reserves the right to suspend your F’ing Rewards Perks and/or terminate your participation in F’ing Rewards if goodr, in its sole discretion, determines that you have violated these Terms, the goodr.com Terms and Conditions, or the goodr.com Privacy Policy, or if the use of your account is unauthorized, for commercial purposes, deceptive, fraudulent, not in the spirit of these Terms or the F’ing Rewards program generally (including any point farming or gaming schemes), or is otherwise unlawful. In the event that you or goodr terminate your participation in F’ing Rewards, then all unredeemed Perks will become void.

Unless otherwise expressly stated herein, the laws of the United States of America and the laws of the State of California, without regard to the principles of conflicts of laws, will govern these Terms, your participation in F’ing Rewards, and all matters relating to your access to, and/or use of, F’ing Rewards.

The personal information collected from you in connection with the Program, including but not limited to purchases made in connection with your Program membership, will be used and disclosed by us in accordance with goodr.com Privacy Policy and the goodr.com Terms and Conditions.

CCPA Financial Incentive Notice. We offer incentives to customers that involve sharing of Personal Information with us.  The Personal Information collected and retained by goodr LLC (“goodr”) in operating these programs is described in our Privacy Policy, and includes your name and contact details, your date of birth information, your payment information, your contact history with us, your purchase and product feedback history, additional details about you, information about your device type and how you use our website, your public reviews and blog comments and inferences from data and other personal information we may collect in connection with your interaction with our service and/or participation in any of our promotional programs. 

Benefits provided through our promotional programs may be deemed a “financial incentive” (e.g., promotional goods) and/or “differential services” (e.g., discounts, coupons, other promotions) under the California Consumer Privacy Act (“CCPA”).  We currently offer the following promotional programs in connection with the collection and retention of Personal Information:

  • Program: We offer rewards to customers participating in F’ing Rewards, consistent with our F’ing Reward Terms and Conditions above.  Participants in F’ing Reward receive promotional offers, including discounts, coupons and opportunities to participate in other promotional opportunities.  You can subscribe to F’ing Reward by logging into your existing goodr.com account or, if you do not already have an account, registering for an account on goodr.com.

     
  • Surveys: You may also be offered the opportunity to participate in a survey.  Participation in the survey may result in goodr collecting additional information from you, including your preferences, experiences, beliefs, opinions, and responses to the survey questions.  In exchange for your participation in the survey, you may be offered a financial incentive, as described above. 

     
  • Limited-Time Promotions: From time to time, we may offer incentives limited to a specific time period, or time limited sweepstakes, contests and other promotions.  Participation in a limited-time offer or promotion is governed by the applicable terms and conditions for the program, which will also describe any financial incentives associated with the promotion.

     
  • Discounts: We also from time to time offer discounts connected to customer’s submission of their email address, phone number or other personal information.  You can always opt out of our marketing emails or SMS messaging at any time.

For CCPA purposes, we treat the value of your Personal Information collected through our promotional programs as equivalent to our total program expenses (excluding the value of benefits).  The value of each program is the value of the program benefits, including discounts and coupons, the value of which will depend on individual customer participation.  By participating in our promotional programs, you agree that the benefits are reasonably related to the value of the Personal Information collected and retained. 

 

Participation in our promotional programs is always optional, and you can terminate program participation at any time as explained in applicable program terms.  You can also contact us at support@goodr.zendesk.com to unsubscribe or cancel your participation.
